Service Agreement, Terms of Use Policy and Hosting Agreement.

This Web Hosting Agreement (this "Agreement") sets forth the terms and conditions of your use of hideal.com for web hosting services. To become a hideal.com account holder, you must read and agree to be bound by all terms and conditions of this Agreement, the fee schedules on the Online Order forms and any policies that are or may be published by hideal.com. This Agreement will become effective when accepted by hideal.com. By posting notice 30 days in advance at a web page available on our web site (http://www.hideal.com) may modify the terms and conditions of this Agreement or the prices of its services, as well as discontinue or change the services offered. You will be bound by the modified Agreement, prices and/or policies if you continue to use the services.

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.

Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegality
In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material.

Undesirable Content
Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work.

Bulk Email
The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Misuse Of Resources
Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum. Excessive data transfer (above 10,000mb) may require your site to be moved to a dedicated server, if you require more information on this please email info@hideal.com

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although hideal.com reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due yearly following the date the account was established, you will not be charged again after this period unless you wish to continue using our services, an email reminder will be sent out 30 days before payments are due.

Invoices will be sent directly to customers via email shortly after the online purchase has been made.

PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down hideal.com runs a limited number of payment options.

Credit / Debit Cards & Cheques:
hideal.com accepts all major Credit Cards including Mastercard, Visa.

DOMAIN REGISTRATION
Domain names will be registered as soon as possible after hosting account has been created on receipt of cleared payments. Domain registrations will take at least 2/3 days to propagate to hosting accounts. There are no guarantees that domain name will still be available after you purchase your hosting account.

CANCELLATION AND REFUNDS
hideal.com reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership less domain registration costs. In the event of hideal.com terminating a customers account due to a situation beyond hideal.com control, the customer is not entitled to a refund. In this event hideal.com will attempt to offer an alternative service athideal.com own sole discretion.hideal.com does not guaranteed that an alternative service will be offered or be available to the customer.

If a customer contravenes hideal.com terms of service a refund will not be issued in the event of a cancellation by hideal.com and/or the customer.

Customers may cancel their account at any time. Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund if the Customer cancels the account prior to the renewal date. In addition accounts that incur domain name registration fees are also non-refundable.

hideal.com will not be responsible for any damages your business may suffer.hideal.com makes no warranties of any kind, expressed or implied for services we provide. hideal.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by hideal.com and its employees. hideal.com reserves the right to revise its policies at any time.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.
